Upon your written request, we’ll delete personal data unless legally required otherwise.

Helios services operate primarily in the United States. By using Helios, you explicitly consent to transferring and storing your personal data in the U.S. If you reside in the European Union, we ensure international transfers adhere to GDPR-compliant safeguards, including standard contractual clauses and appropriate security measures.

Helios is intended for users age 18 and over. We do not knowingly collect data from users under 18 years old. If we discover any collected data from minors, we’ll delete it promptly upon notification.

13. Customer’s Responsibility Regarding User Data

You explicitly acknowledge responsibility for ensuring all user data you upload, store, or process through Helios complies with applicable privacy laws, regulations, and standards (GDPR, CCPA, HIPAA, etc.). You indemnify Arc Line and North fully from claims arising from your non-compliance with privacy obligations.

14. Anonymized and Aggregated Data

We retain the right to anonymize and aggregate your data to improve services, develop new functionalities, train AI models, or provide analytics to third-party providers under strict confidentiality. Aggregated data never personally identifies you or your users.

15. Explicit Consent and Acceptance

By using Helios, you explicitly consent to data collection, processing, storage, transfer, and sharing as outlined herein. You explicitly agree that any dispute regarding privacy is subject to this Privacy Policy and our Terms of Service.

16. AI and Automated Decision-Making Disclosure

Helios utilizes advanced artificial intelligence algorithms and automated decision-making processes to deliver personalized insights, task management, analytics, and recommendations. Customer explicitly acknowledges and agrees to the use of these technologies and understands that AI-driven decisions or recommendations may contain errors, biases, or inaccuracies due to inherent limitations in the underlying data or algorithms. Arc Line and North disclaims all liability arising from decisions or actions Customer or Users take based on AI-generated recommendations or automated outcomes.

17. Regulatory and Industry-Specific Compliance Disclaimer

Customer explicitly understands that Helios is a general-purpose task and data management platform, and Arc Line and North makes no representation or warranty that Helios complies with specific industry standards or regulations (such as HIPAA, SEC compliance, FINRA rules, financial regulatory frameworks, or other specialized legal requirements). Customer explicitly agrees to independently verify Helios’ suitability and compliance with specific regulatory or legal requirements before deploying the Service for sensitive or regulated activities.

18. Customer Responsibility for Sensitive Information

Customer explicitly agrees it will never upload, store, or process highly sensitive information (such as Social Security numbers, protected health information, sensitive financial information, credit card numbers without secure processing, or classified data) without appropriate prior consent and written agreements from Arc Line and North. Customer assumes full responsibility and indemnifies Arc Line and North fully against any and all liabilities arising from unauthorized use or processing of sensitive information within Helios.

19. Incident Response and Notification Disclaimer

While Arc Line and North will make reasonable efforts to identify, contain, and notify affected parties of data breaches or security incidents, Customer acknowledges and explicitly agrees that Arc Line and North is not responsible for damages arising from notification delays caused by circumstances beyond its reasonable control. Customer agrees that Arc Line and North’s sole obligation, if a data breach is discovered, is to notify Customer promptly and provide reasonable cooperation for remediation efforts.

20. Third-Party Data Responsibility and API Risks

Helios integrates with third-party applications through APIs or connectors. Customer explicitly acknowledges Arc Line and North does not control, and expressly disclaims liability related to, the data security, privacy, or accuracy of any third-party application data or services. Customer assumes all risks associated with sharing information or connecting accounts through APIs or integrations, and fully indemnifies Arc Line and North from related third-party data breaches or privacy violations.

21. Intellectual Property Clarification Regarding User Data

Customer explicitly retains ownership rights to all personal and business-specific data uploaded into Helios ("User Data"). However, Customer explicitly grants Arc Line and North a royalty-free, worldwide, transferable license to process, use, and analyze User Data as necessary to operate Helios, improve the Service, develop AI models, perform analytics, and offer generalized insights or aggregated anonymized industry-level trends.

22. Limitation on Liability for Privacy-Related Damages

To the fullest extent permitted by law, Customer explicitly acknowledges that Arc Line and North will never be liable for indirect, consequential, punitive, or incidental damages arising from privacy or data protection issues, including but not limited to unauthorized data access, cyber-attacks, ransomware, or data loss, even if advised of such possibility. Arc Line and North’s total liability relating to privacy or data protection claims will never exceed the total subscription fees paid by Customer during the 12-month period preceding such claim.

23. Data Accuracy and Correction Responsibility

Customer explicitly agrees it is solely responsible for ensuring accuracy, completeness, and timeliness of all personal and business information stored, managed, or processed within Helios. Arc Line and North explicitly disclaims any liability arising from decisions, errors, or harm resulting from inaccurate or incomplete User Data provided or maintained by Customer or its Users.

24. Waiver of Jury Trial and Class Actions for Privacy Disputes

Customer explicitly agrees that all disputes related to this Privacy Policy will be resolved through individual binding arbitration, and Customer explicitly waives any right to jury trials or participation in class actions, group litigation, or consolidated arbitration proceedings regarding any privacy-related disputes or claims against Arc Line and North.

25. Mandatory Privacy Training and User Education Responsibility

Customer explicitly acknowledges sole responsibility for ensuring all Users are adequately trained and informed regarding privacy compliance obligations, data usage policies, and data security best practices when using Helios. Arc Line and North explicitly disclaims liability arising from insufficient or improper User training, user error, or negligence.

26. Explicit User Consent & Acceptance of All Privacy Risks

By using Helios, Customer explicitly acknowledges having read, understood, and fully accepted all privacy practices, data sharing, limitations, disclaimers, indemnifications, and risk allocations described within this Privacy Policy and Terms of Service. Customer agrees this consent is fully informed, explicit, and provided voluntarily.

27. Changes to this Privacy Policy and Customer’s Obligation to Review

Arc Line and North reserves the right to modify this Privacy Policy at any time. Customer explicitly acknowledges that continued use of Helios after updates constitutes acceptance of changes. Customer explicitly agrees it bears sole responsibility to review this Privacy Policy regularly for updates.

28. Privacy Claims Limitation Period

Customer explicitly agrees that any privacy or data-related claims must be brought within one (1) year of the event giving rise to the claim, or such claim shall be permanently barred. This limitation period applies regardless of applicable statutes or regulations providing longer time periods.

29. Severability and Full Agreement

If any provision of this Privacy Policy is deemed invalid or unenforceable, all remaining provisions will remain fully effective. This Privacy Policy and our Terms of Service represent the complete agreement regarding privacy practices between Arc Line and North and Customer.

30. Evolving Privacy Law Disclaimer

Customer explicitly acknowledges that privacy and data protection laws, regulations, and standards are continuously evolving and subject to frequent changes. Arc Line and North makes no representation, warranty, or guarantee that Helios will remain compliant with all future amendments or new privacy regulations. Customer explicitly agrees to assume sole responsibility for regularly monitoring and verifying its compliance obligations under evolving privacy laws applicable to Customer’s jurisdiction and activities.

31. Automated Profiling and Decision-Making Notice

Customer explicitly acknowledges and agrees that Helios may employ automated profiling, analysis, or decision-making technologies based on User data and interactions within the Service. Customer explicitly consents to such automated profiling and decision-making activities and acknowledges that Customer retains responsibility for assessing and addressing any legal or regulatory obligations related to automated profiling under applicable laws, including the GDPR, CCPA, or other applicable data privacy legislation. Arc Line and North explicitly disclaims all liability arising from automated profiling, analysis, or decision-making activities, including any potential legal, financial, regulatory, or reputational risks or consequences.

32. Explicit Disclaimer of Privacy-Related Warranties

Except as explicitly stated within this Privacy Policy, Arc Line and North expressly disclaims any and all warranties, whether express or implied, regarding privacy, data protection, regulatory compliance, security measures, fitness for a particular purpose, merchantability, accuracy, or completeness of the Service. Customer explicitly acknowledges acceptance of Helios “as is,” with all inherent privacy-related risks, and expressly assumes full responsibility for privacy compliance and data protection when using Helios.

33. Experimental Features and Beta Testing Disclaimer

Customer explicitly acknowledges and agrees that Helios may occasionally provide experimental, beta, or pre-release features. These features may be subject to increased errors, inaccuracies, performance issues, or changes without notice. Customer explicitly assumes all risks associated with using experimental or beta features and explicitly agrees Arc Line and North bears no liability arising from the use or reliance upon such features.
